Legal
Last updated: [date]. Please read carefully before using TABLE.
TABLE. (“TABLE”, “we”, “us”) is operated by [legal entity name, registration number, registered address] (“the Company”). TABLE is an online directory and introduction platform based in South Africa that allows independent massage therapists (“Therapists”) to list their services and allows members of the public (“Clients”) to find and request appointments with them.
TABLE does not provide massage, spa, or any other therapeutic services. We do not employ, engage, train, supervise, insure, or control any Therapist listed on the platform. Therapists are independent, self-employed business owners who list their own services at their own discretion.
Nothing in these Terms, and nothing about a Therapist’s presence on TABLE, creates an employment relationship, agency, partnership, franchise, or joint venture between TABLE and any Therapist or Client. Therapists are not agents, representatives, or employees of TABLE for any purpose.
Any contract for the provision of massage services is formed directly and solely between the Client and the Therapist. TABLE is not a party to that contract and has no obligation to perform, and no liability arising from, any treatment session.
Before a Therapist is listed, TABLE conducts an interview and review of their application. This is a curation step to maintain the quality and tone of the directory. It is not a background check, criminal record check, licence verification, insurance verification, or medical/professional certification, and it does not constitute a warranty or guarantee of any kind as to a Therapist’s skill, qualifications, conduct, reliability, honesty, or safety. Client reviews shown on a profile reflect the opinions of individual reviewers and are not verified for accuracy by TABLE beyond the moderation described in our Privacy Policy.
A “booking request” submitted through TABLE is an introduction only — it does not create a confirmed appointment until the Therapist (and, currently, TABLE’s front desk) has confirmed it directly with the Client. Arrangements for the treatment itself (time, place, price, method of payment, cancellation) are agreed directly between Client and Therapist. TABLE does not process payment for treatments and is not responsible for any payment dispute between a Client and a Therapist. TABLE’s own monthly fee to Therapists is solely for the listing service and is unrelated to any individual treatment.
Massage treatments — particularly hotel and home visits, where a Client invites a Therapist they have not previously met into a private space, or a Therapist attends a Client they have not previously met — carry inherent risks. By using TABLE, both Clients and Therapists acknowledge these risks and agree that they arrange and attend appointments entirely at their own risk and discretion. We encourage (but do not require) common-sense precautions: confirming identity before an appointment, letting someone else know the time and location of a booking, and meeting in a way that feels safe to you.
TABLE lists therapeutic massage services only. Sexual services, and any content, conduct, or communication of a sexual nature, are strictly prohibited on the platform and in any interaction arranged through it. We reserve the right to immediately remove any Therapist listing or bar any Client from the platform, at our sole discretion, in response to a credible report of misconduct, illegal activity, or a breach of these Terms — but we make no guarantee that such conduct will not occur, and we are not liable for any act or omission of a Client or Therapist, including but not limited to injury, assault, theft, property damage, or any other harm arising from an appointment arranged through TABLE.
Therapists are solely responsible for: holding any qualification, registration, or licence required by South African law to offer their services; their own public liability and any other insurance; their own tax, VAT, and other regulatory obligations; and their own professional conduct. TABLE makes no representation that any Therapist holds any particular qualification unless explicitly and individually stated on their profile.
To the maximum extent permitted by South African law, TABLE, its directors, employees, and the Company exclude all liability for any direct, indirect, incidental, or consequential loss or damage arising from: your use of the platform; any appointment, treatment, or interaction arranged through it; the conduct of any Client or Therapist; or any inaccuracy in a listing or review. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for gross negligence or fraud, or any right you have under the Consumer Protection Act 68 of 2008.
Each Client and Therapist agrees to indemnify and hold harmless TABLE, the Company, and its directors and employees against any claim, loss, damage, cost, or liability (including reasonable legal costs) arising out of or connected to their use of the platform, their conduct, or any appointment arranged through it.
Reviews are the personal opinion of the registered reviewer, submitted on the understanding that they reflect a genuine experience. We moderate reviews before publication as described in our Privacy Policy, but do not independently verify every factual claim within a review, and are not liable for the content of a published review.
We may update these Terms from time to time; the current version always applies. Material changes will be noted on this page with an updated date.
These Terms are governed by the law of the Republic of South Africa, and any dispute is subject to the jurisdiction of the South African courts.
